Fingerprinting for hazardous materials haulers

The USA Patriot Act requires all states to conduct background checks before issuing, renewing, or transferring a hazardous materials ("H") endorsement on a commercial driver license (CDL). Background checks include a fingerprint check done by the Federal Bureau of Investigation (FBI). Individuals identified as posing a security threat may be denied an "H" endorsement.

Hazmat haulers must first apply for an "H" endorsement with the Wisconsin Division of Motor Vehicles (DMV). After DMV determines a driver meets the requirements to haul hazardous material and passes the required tests, etc., the driver will be given form MV3735 - Application for "H" endorsement, and information on how to obtain the fingerprint collection services.

In most cases, DMV will issue a CDL to the customer at the DMV service center. However, pending completion of the required background check, the CDL will not contain an "H" endorsement.

Commercial drivers seeking a Wisconsin "H" endorsement should know these facts about the implementation of the USA Patriot Act.

Fingerprinting process

Promissor, a Pearson VUE Business, has been selected as the vendor to collect fingerprints for hazmat haulers, teachers, childcare providers, private investigators, etc.

Pearson VUE is only a collection point and will not review background or customer information. All collected personal data will be protected and secure.

Fingerprinting services are provided by Pearson VUE at their test/service centers throughout the state. Services will be available 8 hours per day, 5 days per week (excluding holidays).

In addition to the non-refundable fee of $44 collected by DMV for a commercial driver license, the fee for a background check, as determined by federal rule, for a hazmat hauler will be $37.25, which will be collected by Pearson VUE. Pearson VUE is not required to accept personal checks.

Drivers must make an appointment with Pearson VUE for the fingerprint service. Pearson VUE will collect some customer information when the appointment is made. To make an appointments call (866) 416-4896 Monday – Friday, excluding holidays, between 8 a.m.-4:30 p.m. CST or via the Internet at Wisconsin Fingerprinting.

Pearson VUE will verify a customer’s identity when they arrive for the appointment and fingerprint collection. At the appointment, the customer will need to provide a photo driver’s license.

Pearson VUE will send fingerprints, customer information, fees, and other requests directly to the Wisconsin Department of Justice (WisDOJ). WisDOJ will forward the needed information to the FBI. Pearson VUE will not correspond with the FBI.

If the Transportation Security Administration (TSA) determines that a driver poses a security threat, it will notify the driver and TSA will provide information to the driver on the appeal and waiver process. Additionally, TSA will notify DMV. This process could take up to 90 days.

If it is determined a driver does not pose a security threat, DMV central office will mail a new CDL with an "H" endorsement to the driver.
